But for anyone moving to the country, the more important question is legal: Uruguay is one of the few countries that clearly separates nationality from citizenship. This determines what a foreigner can obtain, what appears on their passport and what happens to their original nationality. This guide explains Uruguayan nationality law, how it differs from legal citizenship and how it applies to foreigners and to children and grandchildren of Uruguayans.

What is Uruguayan nationality?

Nationality is a person’s original bond with the Uruguayan State. Under the Constitution and Law 16.021, Uruguayan nationals are:

People born anywhere in the territory of the Republic.

Children of a Uruguayan father or mother, wherever they were born, who meet the conditions to become natural citizens (settling in the country and registering in the Civic Registry).

Uruguayan nationality cannot be acquired through residence, investment or marriage, and it cannot be lost: under Article 81 of the Constitution, it is not lost even by naturalizing in another country.

Natural citizenship vs. legal citizenship

Natural citizen

Legal citizen

Who

Born in Uruguay, or registered child of Uruguayans

Foreigner settled in Uruguay who meets Article 75 requirements

How obtained

By birth or parentage

Application to the Electoral Court after 3 or 5 years of residence

Uruguayan nationality

Yes

No: keeps original nationality

Vote and passport

Yes

Yes

Can become President

Yes

No

Can be lost

Never

By later naturalization in another country

Uruguay naturalization: can a foreigner become a Uruguayan national?

No. A foreigner cannot naturalize as a Uruguayan national. What they can obtain is Uruguayan legal citizenship: after 3 years of habitual residence with a family established in the country, or 5 years without one, plus good conduct and means of support.

So when people talk about “Uruguay citizenship by naturalization”, they mean legal citizenship. A foreigner’s children born in Uruguay, however, are Uruguayan nationals from birth.

What it means in practice for a legal citizen

You vote and can hold a Uruguayan passport. Political rights are full, except for some offices (the Presidency requires natural citizenship and other elected offices require years of legal citizenship).

You keep your original nationality. Uruguay does not require you to renounce it.

Your passport reflects the distinction. On a legal citizen’s passport, the nationality field does not always read “Uruguayan”, which can lead to questions at some borders and affect visa exemptions.

You can lose legal citizenship. If you later naturalize in another country, it is lost (Article 81). A national never loses nationality.

The nationality status of legal citizens has been under parliamentary discussion. Before making decisions based on this point, confirm the rules in force for your case.

Uruguayan nationality by descent: children and grandchildren

Children of a Uruguayan father or mother born abroad are entitled to nationality and natural citizenship with no years of residence; since Law 19.362, so are grandchildren of people born in Uruguay. See Uruguay citizenship by descent.

Can you get Uruguayan nationality through marriage?

No. Marrying a Uruguayan does not grant nationality or citizenship automatically; it makes residency easier and allows legal citizenship after 3 years. See Uruguay citizenship by marriage.

How many nationalities can a Uruguayan hold?

Uruguay sets no limit: a national can acquire other nationalities without losing Uruguayan nationality, and a legal citizen keeps their original one. The exception is legal citizenship, which is lost by later naturalization elsewhere. More in Uruguay dual citizenship.

Nationality, citizenship and residency compared

Legal residency

Legal citizenship

Nationality

Who holds it

Foreigners living in Uruguay

Foreigners with 3 or 5 years of residence

People born in Uruguay and children of Uruguayans

Granted by

Immigration / Foreign Ministry

Electoral Court

Held by birth or parentage

Vote and Uruguayan passport

No

Yes

Yes

Can be lost

Yes

Yes, by later naturalization

No

If you are still at the stage of moving, the starting point is legal residency in Uruguay.

Uruguayan nationality FAQ

<details>

What is the nationality of Uruguay?

Uruguayan (uruguayo / uruguaya in Spanish).
