Practice area
We advise and act in disputes over assets, funds, receivables, real estate and shareholdings, both in Uruguay and in matters that require coordination with lawyers in other jurisdictions. We step in when the dispute already exists or when a legal problem prevents you from dealing with an asset.
Approach
An unpaid debt, a partner holding on to company funds, a separation in which undeclared assets come to light, an inheritance that cannot be sold or a property with a defective title. In every case there is something specific to recover, claim or put in order, and every month that goes by can weaken the client’s position.
Scope
We act in disputes over assets, funds, receivables, real estate and shareholdings:
01
Debt collection and breach of contract. Recovery of commercial and contractual debts, through negotiation or court proceedings.
02
Disputes between partners. Disputes over company funds, assets and shareholdings, accounting claims and financial claims between partners.
03
Disputes between spouses and family members. Disputes over assets and funds in separations, divorces, estates and other family conflicts.
04
Real estate disputes and regularisation of rights. Defective or qualified titles, disputes over ownership, possession and occupancy, recovery of property and adverse possession.
05
Inheritance rights over assets and property. Assignments of inheritance rights, legacies, partitions and allocations, especially when there is a dispute or the assets cannot be dealt with.
06
Assets abroad. Coordination of claims and proceedings with lawyers in the jurisdictions involved.
When it makes sense
This service is for people who already have a specific problem, for example when:
How we work
Not every dispute is settled in court, and not every claim is worth what it costs. That is why we start by understanding the case and telling you clearly what can be achieved.
01
We review the background, the documents and the status of the assets involved.
02
We assess whether the claim is legally and economically viable, with estimated costs and timeframes.
03
We choose the route: negotiation, regularisation or litigation, and the measures needed to protect the assets.
04
We pursue the claim and coordinate the notary and, where needed, colleagues abroad.
Tell us what happened and what you want to recover. We review the background and tell you which route makes sense.
Frequently asked questions
Recovery of commercial and contractual debts, disputes between partners, disputes over assets in separations, divorces and estates, title and possession problems with real estate, inheritance and legacy disputes, and claims over assets or funds held in another country.
No. In many cases a well-prepared negotiation, backed by a clear litigation strategy, resolves the dispute faster and at a lower cost. When that is not possible, we bring the actions that apply.
Before taking any action we review the background, the available evidence, the situation of the debtor or the assets and the estimated cost of the proceedings. If the claim is not viable or does not make economic sense, we tell you.
Yes. We work with clients who live abroad and have assets, receivables or inheritances in Uruguay, and we coordinate with lawyers in other jurisdictions when the assets or the other party are outside the country. We work in English, Spanish and Portuguese.
We study the background to identify the problem and decide how to cure it: it may require completing an estate, signing missing documents, a court action or, in some cases, adverse possession. We coordinate with the notary so that the property can be sold.
A summary of what happened and the documents you have at hand: contracts, invoices, title deeds, correspondence with the other party or estate documents. With that we carry out a free initial assessment.
